系列（事实上这个概念包括前两者）以及 CC 系列。其中，BSD 和 GNU 许可证更广泛应用于软件及其源码方面，而CC系列协议主要用于文字或艺术类的创作内容上。为什么要使用 CC 协议？由于网络世界的公开性与匿名性，创作者的版权内容难以得到恰当的保护。而创作者也没有一个恰当的、合乎法律的主动声明去保护自己的创作内容。CC 协议便应运而生。知识共享组织设计了一系列协议，目的是为了在作者保留相关版权权利的前提下，作品在满足特定条件的情况下便可以被自由复制、传播，在不违反版权保护法律的情况下获得、分享更多创作于素材。选择 CC 协议能得到以下目的：作者版权仍得到保留。主动宣告他人在协议限定范围内的分享行为可以不向作者告知。分享行为包括：网络上的发表、转载、二次发布，实体中的转载、印刷、使用、展览等，一般而言，这些行为概括为“转载”、“使用”、“二次演绎”三种形式。主动宣告不允许的使用行为。包括：商业性使用、二次创作、改变授权方式的再次分享。但是根据 CC 协议原文设置，有以下限制：原则上适用于全世界范围。协议启动后可以撤回，但是在协议存续期间签发出去的授权将继续有效。换言之，你可以撤销协议，但不能撤销已经发布出去的授权。CC 协议如何构成？*以下涉及 CC 协议内容的文本，是根据 CC 4.0 协议文本翻译的非官方版本。CC 协议分为三个部分：可被程序识别的特征源码、可为一般人所理解的简易文本、正规的法律文本。其中，借由可被程序识别的特征源码，使得搜索引擎能够快速判断该内容是否为开放版权的内容，从而向使用者提供更精准的结果，这一设计也是 CC 协议的初衷。但是一般而言，在网络上普遍采用的可视结果是连接到 CC 官方网站的图片标识与简易声明。考虑到法律文本过于复杂与冗长，本文的介绍以简易文本为主。CC 协议分为6个版本，每个版本在允许以及限制行为上都稍有区别。每份协议的简易文本都包括允许行为、限制行为、声明三部分。CC 协议所有允许的行为：分享 – 在任何媒介或格式下再分发、传播本创作。修改 – 重混、转换、依据本创作进行再创作。只要遵守条款规定，授权人将不能撤回你使用本创作的自由。CC 协议所有限制的行为：署名（BY） – 你必须以给予姓名标注，并提供本许可证的链接。同时你需要声明公开的创作是否经过修改。你可以采用恰当的形式将相关信息表述出来，但不得以任何形式暗示授权人已正式认可了你以及你的使用行为。非商业性（NC） – 你不得将本创作运用于商业目的。禁止演绎（ND） – 如果你对本创作进行了重混、转换、依据本创作进行再创作等行为，你不得再次公开散布经过修改的创作。意即，你只能全文转载或部分摘抄本创作中的内容，而不允许作出任何改动。相同方式共享（SA） – 如果你对本创作进行了重混、转换、依据本创作进行再创作，你必须依据本创作采用的许可证来分发你的创作。不得增加额外限制 – 你不能增设任何法律限制或是技术限制，来限制他人进行本许可证已经允许的行为。其中，加粗部分是六种协议文本都包含的。如何选择 CC 协议？各个协议又何不同？若要选择 CC 协议，请回答以下两个问题：1、是否允许依据你的创作进行的再创作被分享？A、是 B、否 C、是，只要在相同的授权条件下。2、是否允许你的创作应用于商业用途？A、是 B、否根据回答你可以使用的协议如下：AA：署名 BYAB：署名-非商业性使用 BY-NCBA：署名-禁止演绎 BY-NDBB：署名-非商业性使用-禁止演绎 BY-NC-NDCA：署名-相同方式共享 BY-SACB：署名-非商业性使用-相同方式共享 BY-NC-SA下面简单介绍一下各个协议：署名（BY）：这是最宽松的协议版本。它可以简单表述为：只要在使用时署名，那么使用者可以对本创作进行转载、节选、混编、二次创作以及商业目的使用。署名-非商业性使用（BY-NC）：只要在使用、公开时进行署名，那么使用者可以对本创作进行转载、节选、混编、二次创作，但不得将本创作或由本创作衍生的创作运用于商业目的。署名-禁止演绎（BY-ND）：只要在使用、公开时进行署名，并且对创作不加任何改动，那么使用者可以使用本创作，包括将其运用于商业目的。署名-非商业性使用-禁止演绎（BY-NC-ND）：使用者可以对本创作进行转载，但不得对本创作进行修改，亦不得依据本创作进行再创作，不得将本创作运用于商业用途。这是最严格的协议文本。署名-相同方式共享（BY-SA）：使用者可以对本创作进行转载、节选、混编、二次创作，可以将其运用于商业用途，唯须署名作者，并且采用本创作的内容必须同样采用本协议进行授权。署名-非商业性使用-相同方式共享（BY-NC-SA）：使用者可以对本创作进行转载、节选、混编、二次创作，但不得运用于商业目的，且使用时须进行署名，采用本创作的内容必须同样采用本协议进行授权。使用范例小明拍摄了一张云南的风光照片，并将其发布在自己的个人网站上。而小红则正在制作一部有关云南风光的宣传片，在找寻素材时，她发现了小明发布的照片。在过去，小明可能没有对照片的版权与使用问题作出任何说明，这使得小红无法判断是否能够使用这张照片。而如果小明没有在网上留下自己确切的联系方式，那可能就会使小红无法联系到小明。小红的选择则不外乎直接使用这张照片，或放弃使用这张照片而寻找版权归属更明确的照片作品。如果小明按照 CC 协议的标准形式，引用了 CC 协议的“署名”协议。则可以在无需再次联系确认的情况下，向其他潜在的使用者表明：只要在为我署名的前提下，你可以无限制地使用这张照片。小红在看见这一协议标示后，便可以放心使用小明的照片，并且无需专门与小明取得联系。而她也恪守约定，在影片的末尾将小明的名字列出，并注明通过 CC BY 4.0 协议授权。如果小红制作的是一部企业定制的短片，而小明发布照片时采用的是 CC BY-NC（署名-非商业使用）协议。那么小红就不能在未联系小明的情况下使用小明的这张照片，除非他专门联系小明，获得小明的商业使用许可。（*CC 协议并不剥夺创作者的版权或获得报酬的权利。即使小明采用 CC BY 协议或其他不含有 NC 选项的协议授权照片，小红同样也可以联系小明并向他支付报酬。而小明采用了 CC BY 协议在互联网发布自己的照片后，也不代表他没有索取或获得因商业使用而支付的报酬的权利。）小刚是一名设计师，工作之余也喜欢自己设计一些图标发布在自己的网站或其他站点上。他为自己的图标元素设定了 CC BY-ND （署名-禁止演绎）协议。小红在为一部商业影片寻找制作素材时发现了小刚的作品，根据使用协议，小红能够使用小刚的素材，但是小红发现这个素材直接引用进影片时不能很好的契合，必须要进行修改。而授权协议不允许这样的修改行为，此时小红只能重循其他素材，或者直接联系小刚寻求获得更宽泛的授权。后来小红发现小刚的另一些作品采用了 CC BY-SA （署名-相同方式共享）协议，这些作品可以允许小红进行修改并运用到商业影片之中。小红便使用了这些素材，并且进行了修改。根据协议，在修改后的图标制作完成后，她必须将这些改动后的图标同样公开到网络上，并且继续采用 CC BY-SA 协议进行授权，不能阻拦其他人使用这些素材。（*CC 协议仅对使用本协议的素材进行规范，在小红的使用案例中，小刚没有限制自己的作品不能运用到商业作品中，所以小红可以进行使用。而小刚约定的相同方式共享也仅仅针对小红基于他提供的作品来修改的衍生作品，对于小红制作的商业影片整体，和商业影片中的其他素材，小刚没有权利要求小红也开放它们的版权。）小刚在 2016 年 1 月 1 日通过 CC BY-SA 协议发布了一张照片，小红于 2016 年 1 月 5 日下载了这张照片并将其运用于自己的商业项目中。2016 年 1 月 10 日，小刚撤销通过 CC BY-SA 协议授权这张照片。2016 年 1 月 12 日，小明在网上发现了这张照片。在这时，小红获得的照片将继续有效，并且她能够遵循协议将这张照片继续使用在其它项目中，小刚不能撤回小红的授权。但是小明却不能再通过 CC BY-SA 协议使用这张照片，只能联系小刚获得专门授权。（*CC 协议是不可撤销的。这就意味着一旦你在 CC 协议下收到了某份素材，即使许可人改变了他（她）的想法，并停止使用 CC 协议分发他（她）的创作，你仍永远拥有在协议条款下使用该素材的权利。当然，你也可以出于对许可人的尊重，遵循他（她）的意愿停止使用该素材。）采用 CC 协议的意义或效果？对于网络创作者而言，采用 CC 协议可以进行主动声明以应对未来创作公开到网络上后可能产生的转载问题。主动提供授权协议，有利于提醒转载者应按照相关协议进行，尽管目前咱们这的版权领域的现象一直都不让人称道，但是随着人们的相关意识的不断增强，也越来越自发地尊重创作者的版权，CC 协议的作用也越来越明显。在发生协议以外的转载行为时，于法于理上也有依据。目前在中国大陆内似乎还未有基于 CC 协议的诉讼。难以否认的是，使用范例里小明的主动约定和小红的守约是一个非常理想化的状况。在实际运用中，可能更多的人会直接使用创作者公开的素材而不去管所谓的授权或者协议。而 CC 协议在当下的网络环境中也近乎一种自律型的规约。但是，当使用、提及的次数多了，相比也能够提高更多人在这方面的意识。尽管前进步伐还很缓慢，但一步步一步步向前，总能改变。关于本地化CC 协议是基于国际法、国际惯例、美国法律撰写的基础版本（即国际版），为适应各国不同的版权政策，一般都需要进行本地化。中国大陆地区对 CC 3.0 协议进行了本地化，以适合中国地区的法律，这也是目前中国最新版本的 CC 协议。根据 CC 组织的说法，4.0 版本在最大程度上实现了在各司法区的适用，从 4.0 版本起，CC 协议可以不必等待各司法区的知识共享组织进行本地化，可以直接使用。目前，在 4.0 版协议发布后，3.0 的中文版就从 CC 官网上消失了，4.0 则还未本地化。本文翻译的是 4.0 国际版的协议。还有个 CC0CC0 是 CC 协议以外的一种新的版权声明协议。采用该协议即代表作者宣布放弃该创作的一切版权，该创作进入共有领域。公有领域是指任何个人或团体都不具有其所有权的知识财产。版权到期的作品，或者创作者公开放弃所有权的作品自动进入公有领域。任何人不具有所有权，意味着这些作品可以被自由地复制，修改，分发和演出——甚至用于商业目的。采用此协议后，该创作则可以被不加限制的引用、转载、二次改编、再发表、运用于商业用途，使用者可以不标示该创作的来源和作者。值得注意的一点是，中国大陆地区并不允许著作者放弃自己的版权，任何情况下引用版权作品的最低限度是注明作者。因此 _百度百科网页新闻贴吧知道网盘图片视频地图文库资讯采购百科百度首页登录注册进入词条全站搜索帮助首页秒懂百科特色百科知识专题加入百科百科团队权威合作下载百科APP个人中心收藏查看我的收藏0有用+10知识共享播报讨论上传视频汉语词语知识共享（Creative Commons），简称CC，中国大陆正式名称为知识共享，台湾地区正式名称为创用CC。是一个非营利组织，也是一种创作的授权方式。知识共享的主要宗旨是增加创意作品的流通可及性，作为其他人据以创作及共享的基础，并寻找适当的法律以确保上述理念。中文名知识共享外文名creative commons简称CC性质非营利组织主要宗旨促进数字作品的自由使用和传播目录1发展由来2版权协议3主要特点4历史案例5法律体系6阻碍分析7共享方式8授权要求9批评发展由来播报编辑知识共享，传统的著作权通常为两种极端，一端是“保留所有权利”，另一端则是“不保留任何权利”（即公有领域，public domain）。知识共享则试图在两者中间广大的灰色地带保有弹性，使得创作者可以“保留部分权利”。知识共享提供多种可供选择的授权形式及条款组合，创作者可与大众分享创作，授予其他人再散布的权利，却又能保留其他某些权利。知识共享的诞生是为了避免现代知识产权以及版权法在信息共享方面的问题，该计划向版权持有人提供数种自由的版权协议，以应用于作者发表在网络上的内容。它同时也提供了描述协议的RDF/XML诠释资料，以利于电脑自动处理及定位。这些努力是为了反击支配了现代社会，而且拘束力日益增加的“权限文化”。这是传统出版者为了维持并加强其在流行音乐、大众电影的寡占，向社会大力推行的一种文化。Creative Commons（知识共享）一般用于设计，摄影，图片作品的开放式分享。版权协议播报编辑四种核心权利，六种常见组合图1 CC 许可协议Creative Commons（知识共享）是一个相对宽松的版权协议。它只保留了几种权利（some rights reserved）。使用者可以明确知道所有者的权利，不容易侵犯对方的版权，作品可以得到有效传播。作为作者，你可以选择以下1~4种权利组合:1. 署名（Attribution，简写为BY）：必须提到原作者。2. 非商业用途（Noncommercial，简写为NC）：不得用于盈利性目的。3. 禁止演绎（No Derivative Works，简写为ND）：不得修改原作品, 不得再创作。4. 相同方式共享（Share Alike，简写为SA）：允许修改原作品，但必须使用相同的许可证发布。知识共享协议允许作者选择不同的授权条款和根据不同国家的著作权法制定的版权协议，版权持有人可以指定以下的条件（详见右图1，点击放大）：在没有指定“nc”的情况下，将授权对本作品进行商业利用；在没有指定“nd”的情况下，将授权创作衍生作品。图2 CC 许可协议这些不同条件共有16种组合模式，其中4种组合由于同时包括互相排斥的“nd”和“sa”而无效；1种没有以上任何条件的协议，它相当于公有领域。在CC 2.0以上的版本，又有5种没有署名条款的协议被列为淘汰，因为98%的授权者都要求署名。简化后剩下6种协议组合（详见左图2，点击放大）：主要特点播报编辑1. 署名（BY）2. 署名（BY）-相同方式共享（SA）3. 署名（BY）-禁止演绎（ND）4. 署名（BY）-非商业性使用（NC）5. 署名（BY）-非商业性使用（NC）-相同方式共享（SA）6. 署名（BY）-非商业性使用（NC）-禁止演绎（ND）在最新Creative Commons（知识共享）3.0协议中，署名(BY)权利成为必选项。相比较于之前协议版本, Creative Commons 3.0极大的简化了协议复杂度。其他 CC 协议美国建国者著作权（Founder's Copyright，简称FC）协议：重塑最早期美国建国者们在设计美国宪法时所提出的版权概念，版权的主要目的是促进文化、艺术等方面的进步，为此版权人可享有的版权保护期限为14年或28年，而不是今天的作者终身加死后70年。特别取样授权（Sampling Plus）、非商业特别取样授权（Noncommercial Sampling Plus）：用于音乐、影片、摄影作品的拼贴混合创作。公有领域（public domain，简称PD）：不保留任何权利。历史案例播报编辑知识共享得到金尼卡奖。知识共享协议类似于开放出版物协议（OPL）和GNU自由文档协议(GFDL)。GFDL协议主要用于软件文档，但是也可以用于其它像维基百科这样的非软件文档的项目。OPL 现在已经消亡了，他的创造者建议新的项目不要再使用它。批评者认为OPL和GFDL协议都还不够“自由”，GFDL与CC协议不同之处在于它要求分发的作品提供一个“透明版本”，也就是说，不能是一个私有或秘密的格式。知识共享在2001年正式运行，劳伦斯·莱斯格（Lawrence Lessig）是创始人和主席。知识共享的最初版本在2002年12月16日发布。本计划在2004年荣获电子艺术大奖网络愿景类金尼卡奖。Creative Commons的董事包括了劳伦斯·莱斯格、James Boyle等长期对现代知识产权进行批评的学者、教授及律师。法律体系播报编辑原本的知识共享协议是以美国法律体系写成的，所以用词可能无法完美地切合其他国家现存的法律。虽然某种程度上不见得如此，但使用美国法律体系，不顾虑本地法律可能导致协议无法执行。为了解决这问题，知识共享推出iCommons（International Commons）计划，调整法律用词以适应各国国情，2004年5月27日，iCommons推出2.0版，至2007年11月30日为止，已有41个国家完成本地化。在使用华文的国家和地区当中，中国台湾已完成Creative Commons的本地化版本，意味在当地的法律下可以使用Creative Commons。中国大陆也由人民大学及CNBlog#org进行本地化，并于2006年3月30日正式发布知识共享中国大陆版 (CC China) 2.5协议。而澳门及新加坡等地目前尚未进行Creative Commons本地化的工作。2008年1月Creative Commons License 3.0香港版已进入本地化公众讨论的阶段。自3.0版开始，原始的协议改以国际法及相关惯例撰写，称为“未移植版”，各司法领域团队再依其法律翻译、修改成该司法领域的适用版本。阻碍分析播报编辑阻碍知识共享的因素分析1.个体的心理因素 [1]个体拥有的知识，特别是隐性知识往往是其长时间所积累的独特的经验知识，一般他们不愿意将其与他人无偿分享。在竞争日趋激烈的组织环璄中，个体所感受的竞争压力使他们认为自己所拥有的知识是自己在组织中价值和地位的保证，如果将所拥有的知识倾囊授予他人，将失去这种独特的竞争优势，那么个体本身的利益无法得到保证。2.组织文化和制度因素在组织文化及制度方面，传统的中国企业文化在评估其工作成果时一般认同拥有独特能力的人，就象师傅对跟自己学习多年的徒弟往往也要保留一手绝活，更何况是其它不相干的人呢。另外在制度方面，许多企业也不能对知识共享的个体利益给予保障，组织中的个体缺乏对共享其知识的信任。因此，知识不能共享的这种问题，也深刻地体现在我国的企业里，相当多企业往往离不开其“一把手”能人，一个原本赢利丰厚的企业在其“一把手”换人之后却很快陷入困境。在某种意义上来说，知识不能共享并转化为组织的资源及竞争优势是其中一个重要因素。3.信息技术误区随着信息技术的发展，知识管理活动在深度和广度方面都有了很大程度地增长，应该说成功的知识管理离不开信息技术的支撑。然而，许多组织的决策者由于缺乏对知识管理共享内涵的理解，错误地认为只要信息系统部门建立了知识管理系统，知识的共享便会水到渠成。事实上成功的知识共享远不只是信息系统，信息技术更多地聚焦于能够在数据库中进行共享管理的知识，这类知识是能够文件化的，更多的是显性知识，却令人遗憾地忽略了隐藏的绝大部分隐性知识。共享方式播报编辑从组织中知识的来源看，组织知识的最主要的原始来源是个人知识，而个人知识的隐性化程度最高，所以个人知识的共享最不容易。个人之间有两种交流知识的形式：文档交流和直接交流。Hansen等人认为，根据个人知识不同的交流方式，组织知识的共享可以分为两种：编码化方法和个人化方法。1.编码化方法指组织通过内部的管理机制和沟通渠道，将个人知识复制成较为显性的知识表现方式，如工作流程，或进一步表达成数据库的形式。这种方法中，信息技术将发挥重要的作用，用以存储编码化的信息。作为一种员工与知识进行交流的工具，编码化方法的基本思想是将解决问题所需的知识标准化。各个组织都或多或少地利用了知识编码方法来提高效率，而方便员工使用的知识编码体系是编码化知识共享成功的基础。在编码化的方法中，知识共享的编码体系可以有两种形式：工作流程和数据库。组织可以根据知识的可编码程度，以及知识本身的性质，将知识编码成工作流程或数据库的形式。编码化的工作流程将知识嵌入到组织的业务流程、信息流程等，将工作流程编码化、规范化甚至标准化。而数据库形式是最显性的表达知识的方法，知识通过编码进入数据库后，就可以方便地被其他组织内部成员使用。2.个人化方法指将没有掌握某种知识的人和掌握该知识的人紧密地联系在一起，知识的共享主要通过人与人之间的直接交流。如处理战略性课题时，由于问题本身复杂又不具有重复性，通过咨询专家之间的交流有助于提高效率。实施个人化方法的基本思想是根据要求，将具有不同领域知识的人组成一个团队，通过团队成员间的相互交流解决问题。根据个人之间的交流方式的不同，将个人化方法分为两种：人—人和人—连接—人。人-人方式指个人之间直接进行交流，面对面或者通过电子邮件等媒介实现信息共享。这种方法适用于个人之间比较了解，可以直接确定谁对某个领域比较熟悉的情况。人—连接—人方式指个人之间通过一种连接工具进行接触，如一张记录所有专家的研究领域的列表，还可以是一个联络小组，专门负责帮助组织内部员工寻找所需求的专家。授权要求播报编辑维基百科所遵守的GNU自由文档许可证（GFDL）允许使用于商业目的，并可散布修改后的衍生创作，因此只有CC BY可与 GFDL 单向相容（CC BY 可改为GFDL, GFDL不可改为 CC BY ）。CC BY-SA 的理念基本上与 GFDL 相同，但是因为一些条款细节有所出入而无法相容（CC BY-SA 要求衍生作品同样以 CC BY-SA 发布，因此不能改以 GFDL 发布）。2005年11月，知识共享中已经有人提出修正案，以增加和 GFDL 的相容性为目标。由于 CC BY-SA 协议要求的是衍生作品同样以 SS BY-SA 协议发布（4.0 版开始允许并入 GPL 协议和 FreeArt 协议），在通常的情况下，可以将此协议下发布的图片等媒体文件不作修改上传至维基百科，并在其图像描述页描述页中注明版权协议为 CC BY-SA，这样并不违反其授权要求。这一方法理论上也适用于 CC BY-SA 协议下发布的文本，但由于位于维基百科的文字往往会经修改后以 GFDL 重新发布；或出现一段文本同时包含衍生自 GFDL 授权文本和 CC BY-SA 授权文本的情况，而发生冲突，因此一般不接受来自 CC BY-SA 协议的文本。数以百万计的网页使用知识共享授权。Jeff Kramer 与知识共享组织合作设立了Common Content，现在由志工维护。媒体集中地（部分上传者选择知识共享授权）：Flickr、Internet Archive、维基共享资源、Ourmedia麻省理工学院开放式课程网页 - Creative Commons (CC) is an international nonprofit organization dedicated to helping build and sustain a thriving commons of shared knowledge and culture. Together with an extensive member network and multiple partners, we build capacity, we develop practical solutions, and we advocate for better open sharing of knowledge and culture that serves the public interest. As part of this work, we help overcome legal obstacles to the sharing of knowledge and creativity to address the world’s most pressing challenges.

In order to achieve our mission, we:

Provide CC licenses and public domain tools that give every person and organization in the world a free, simple, and standardized way to grant copyright permissions for creative and academic works; ensure proper attribution; and enable others to copy, distribute, and make use of those works

Work closely with major institutions and governments to create, adopt and implement open licensing and ensure the correct use of CC licenses and CC-licensed content

Support the CC Global Network, a community initiative working to increase the volume, breadth, and quality of openly available knowledge worldwide

Offer the CC Certificate, an in-depth course for people interested in becoming experts in creating and engaging with openly licensed works

Run the CC Open Culture Program, to support the development of a thriving open culture ecosystem among cultural heritage institutions and their users

Run the CC Open Education Program, to ensure publicly funded knowledge (educational resources, research and data) is open and freely available for everyone to learn, discover and contribute

Run the Open Climate Campaign, to promote open access to knowledge to accelerate progress towards solving the climate crisis and preserving global biodiversity

Lead the Open Climate Data project to facilitate the opening and sharing of climate datasets and data models as a step toward addressing climate change

Produce CC Global Summit, an event that brings together an international group of educators, artists, technologists, legal experts, and activists to promote the power of open licensing and global access.

Support CC Platforms for global communities working on open education, open culture, and copyright policy.

The primary goal of the Creative Commons Developer Community (CCDC) is to build a community of developers around the development of tools facilitating Creative Commons' licenses and standards.

College Students

College students can participate with CC through Students for Free Culture, an international student organization working to promote free culture ideals, such as cultural participation and access to information.
